1. Scope of Application
These Terms and Conditions apply to all services provided by Myths of Etheria, including but not limited to:
The Flyff private game server,
The official website, forum, Discord server, and related community platforms,
User accounts, characters, virtual items, Donate Coins, and in-game services,
Donation systems, payment processing, and customer support.
By registering an account, logging in, donating, or using any service, the user agrees to these Terms and Conditions.
Conflicting or deviating terms of the user shall not apply unless explicitly agreed to in writing by the operator.
2. Definitions
User / Player – Any natural person using the services of Myths of Etheria.
Account – A registered player account containing characters, inventory, currencies, and progress.
Donation – A voluntary monetary contribution to support the operation and development of the server.
Donate Coins – A virtual, non-transferable digital currency granted as a thank-you bonus for a donation, usable exclusively in-game.
Virtual Goods / Digital Content – All in-game items, services, currencies, ranks, or benefits that exist only within the game environment.
Chargeback / PayPal Case – Any payment dispute, refund request, reversal, or buyer protection claim initiated via PayPal or another payment provider.
3. Eligibility and Minors
Users must be legally competent or have permission from a legal guardian to use the services and make donations.
Donations made by minors without parental consent may lead to account suspension.
The operator reserves the right to request proof of consent or to suspend accounts if misuse is suspected.
4. Account Registration and Security
Users are responsible for maintaining the confidentiality of their login credentials.
All actions performed through an account are attributed to the account owner.
Account sharing, selling, or transfer is prohibited unless explicitly allowed.
The operator may suspend or terminate accounts in case of security risks or violations.
5. Nature of Donations and Donate Coins
Donations are voluntary contributions to support server maintenance, development, and operation.
Donations are not purchases of real-world goods or services.
As a thank-you, users receive Donate Coins, which:
Have no real-world monetary value,
Are not legal tender,
Cannot be exchanged for real money,
Exist solely within the game.
Donate Coins can be exchanged in-game for virtual items or services.
All virtual goods remain the property of the operator at all times.
6. No Ownership of Virtual Goods
Users acquire no ownership rights to Donate Coins, items, or services.
All virtual goods are licensed for use and may be modified, removed, or reset at any time.
The operator may rebalance, change, or remove items for technical or gameplay reasons.
7. In-Game Trading and Transfers
In-game trades between players are performed at the players’ own risk.
The operator is not obligated to restore items lost due to scams or player disputes.
Real-money trading (RMT), selling Donate Coins or items for real money, is strictly prohibited.
The operator may reverse trades or remove items if abuse or fraud is detected.
8. Refunds, PayPal Disputes, and Chargebacks (Strict Rule)
8.1 Refunds Only via Operator Support
Any request for a refund must be made exclusively via the official Myths of Etheria support system.
Users agree not to initiate PayPal disputes, chargebacks, or payment reversals without first contacting the operator.
8.2 PayPal Disputes as a Serious Breach of Contract
Initiating a PayPal case, chargeback, or payment reversal without prior agreement from the operator constitutes a serious violation of these Terms.
In such cases, the operator reserves the right to:
Immediately suspend the account,
Remove or invalidate Donate Coins and all obtained virtual goods,
Permanently ban the account after review.
8.3 Evidence and Digital Delivery Proof
In the event of a PayPal dispute, the operator may provide evidence including:
Payment transaction IDs,
Shop and coin delivery logs,
In-game logs (item acquisition, trades, inventory changes),
Account login and IP history,
Proof of digital content delivery and usage.
These records may be submitted to PayPal or other payment providers.
8.4 Transfer or Trade of Donate Coins / Items
If Donate Coins or items obtained through a donation have been:
Traded,
Gifted,
Sold,
Transferred to other players,
any refund attempt will be considered intentional abuse.
In such cases, the operator may:
Permanently ban the original account,
Remove or rollback items and currency from all involved accounts,
Sanction recipient accounts if there is reasonable suspicion of knowing involvement.
8.5 Fees and Damages
Any fees, penalties, or financial losses caused by chargebacks may be claimed from the user where legally permissible.
Accounts may remain suspended until all disputes are resolved.
8.6 Mandatory Consumer Rights
Mandatory consumer protection laws are not excluded.
These rules define the contractual process and consequences of misuse or fraudulent behavior.
9. Right of Withdrawal – Digital Content (EU/Germany)
By donating, the user explicitly agrees that:
Donate Coins are delivered immediately,
Digital execution begins instantly.
The user acknowledges that this waives the statutory right of withdrawal once delivery has started, in accordance with EU consumer law.
This consent must be explicitly given during the donation process (e.g. checkbox).
10. Sanctions and Enforcement
Violations may result in:
Warnings,
Temporary suspensions,
Removal of virtual goods,
Permanent bans.
Severe violations (cheating, exploiting, chargeback abuse, RMT) may result in immediate permanent bans without warning.
11. Availability and Changes
The operator does not guarantee uninterrupted service.
Maintenance, updates, resets, or shutdowns may occur at any time.
No compensation is provided for downtime or changes.
12. Liability
Unlimited liability applies only in cases of intent or gross negligence.
For minor negligence, liability is limited to foreseeable damages.
No liability for:
Internet failures,
Third-party attacks,
User-caused data loss.
13. Data Protection
Personal data is processed in accordance with applicable data protection laws.
Logs may be stored for security, fraud prevention, and dispute resolution.

14. Amendments
The operator may modify these Terms if required by law or operational needs.
Continued use of the services constitutes acceptance of updated Terms.
15. Governing Law and Final Provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
If any provision is invalid, the remaining provisions remain effective.
The language of the contract is English.
